Peter K. Hess, LESI President

Patent infringement and invalidity proceedings in a number of technical fields, in particular medical devices, laser technology, computer-related inventions such as semiconductor technologies, telecommunications, and software; licensing/technology transfer; complex patent prosecution cases.

Recently, Peter was lead patent counsel of a BARDEHLE PAGENBERG team of patent attorneys and attorneys-at-law representing a global software company in a series of worldwide telecommunication patent infringement procedures in Germany, and a global DRAM manufacturer in German invalidity proceedings against global computer companies.

Further important worldwide noted cases have concerned infringement and invalidity proceedings concerning DRAMS (RAMBUS vs. Infineon), hardware emulation systems for the design of semiconductor devices (Quickturn vs. Mentor Graphics), tooth brushes (Omron vs. Procter & Gamble), and automotive parts (particularly for BMW). A common characteristic of many cases is the managing of parallel patent litigations in a number of different European jurisdictions. Most of these cases required a careful coordination with parallel litigation in the US.

Peter Hess is repeatedly rated in many international legal journals as leading expert in the patent profession, like e.g. the "Guide to the World's Leading Patent Law Practitioners", "Best Lawyers", "Legal 500 EMEA", "Juve German Commercial Law Firms", IAM 1000 “The World´s Leading Patent Practitioners”, and others.

Prof. Hanna Stakheyeva

Hanna Stakheyeva is an Assistant Professor at the Bogazici University since April 2016, and also BU IP Council Member. She has been teaching International Business Law, Intellectual Property and Competition, and Business Communications at the Department of International Trade. Hanna conducts research into competition law and IP matters with a particular focus on the EU, Ukraine and Turkey. She has numerous publications both in academic and business journals. Prior to joining the Bogazici University, Prof. Stakheyeva worked as a competition lawyer at Baker & McKenzie (Kyiv, Ukraine) and King & Wood Mallesons (Brussels, Belgium). She has been a visiting lecturer at the annual summer school on M&A organized by ELSA in collaboration with ACTECON (Istanbul, Turkey). In June 2017 she was invited by the WTO and WIPO to attend the colloquium on Intellectual Property in Geneva (Switzerland) and present her speech on IP and Competition Law in contemporary world. Prof. Stakheyeva is a member of the Bar (Advokatura) of Ukraine and the Academic Society for Competition Law. Prof. Stakheyeva graduated from the Kyiv National Taras Shevchenko University (B.L and Ph.D. in International law) and University of Amsterdam (LL.M in European Business law). She also holds International Baccalaureate diploma from the UWC "Atlantic" (Wales, UK). Prof. Stakheyeva is fluent in Russian, Ukrainian and English.

Prof. Stakheyeva's presentation at this BU-TTO and LES event focuses on interplay between Intellectual Property and Competition Law. The enforcement of EU competition law in the various industries has recently become a major trend. The most common concern from a competition law perspective is the possible violation of competition law due to the existence of patents.trademarks, which grant exclusive power that may potentially be abused by the IP right holders . The presentation gives a general overview of the interplay between competition law and intellectual property rights in such sectors as pharmaceuticals, IT, luxury brands, analyses potentially problematic agreements from the point of view of the competition rules, and provides some highlights of the latest investigations launched/conducted at the EU and national level.
